TERMS & CONDITIONS

By booking a session with Megan Michael Photography (“Studio”), you agree to the following Terms & Conditions. These policies are designed to protect both the client and the Studio while ensuring a seamless, elevated portrait experience.

1. Retainer & Payment Policy
A session retainer is required to reserve your date and time.

  • All retainers are non-refundable and non-transferable.

  • Your session date is not secured until the retainer is received.

  • Retainers compensate the Studio for reserving time, staffing, preparation, and lost booking opportunities.

Remaining balances (if applicable) are due as outlined in your booking agreement.
2. All Sales Are Final
Due to the custom nature of photography and artwork:

  • All sales are final.

  • No refunds, exchanges, credits, downgrades, or order changes will be issued on digital files, products, albums, wall art, or printed materials.

  • Once an order is placed and processed, it cannot be altered, canceled, or substituted.

Purchasing decisions made during the ordering appointment are considered final and binding.
Each product is custom-designed and created specifically for you.
3. Cancellation & Rescheduling
Because each session time is reserved exclusively for you, the following policies apply:
A minimum of 7 days’ notice is required to avoid additional fees.

  • Sessions canceled or rescheduled within 7 days of the appointment time will incur a $100 rescheduling fee.

  • Reschedules are subject to availability.

If more than one scheduling change occurs, a new non-refundable retainer will be required to secure a new date.
No-shows or same-day cancellations will result in forfeiture of the retainer and may require a new retainer to rebook.
4. Late Arrivals
Clients arriving late may experience reduced shooting time. Sessions will conclude at the originally scheduled time to maintain fairness to all scheduled clients.
If a client arrives 15 minutes or more past their scheduled appointment time, the session will require rescheduling and may be subject to the applicable rescheduling fee.
5. Ordering Appointment
Megan Michael Photography operates as an In-Person Sales (IPS) Studio.

  • All purchasing decisions are made at your scheduled ordering appointment.

  • Galleries are not held indefinitely.

  • If you choose not to purchase at your ordering appointment, images are not archived for future viewing.

All selections, package choices, upgrades, and product decisions made during the ordering appointment are final. Changes, substitutions, or additions cannot be made after the appointment concludes.
6. Image Storage
The Studio archives images for a limited time only.

  • Unpurchased images are purged after your ordering appointment.

  • Purchased images are stored for 30 days following delivery.

  • The Studio is not responsible for long-term image storage.

Clients are responsible for backing up all digital files immediately upon receipt.
7. Artistic Discretion
The Studio retains full creative control over:

  • Posing

  • Lighting

  • Editing style

  • Image selection

By booking, you acknowledge that you are hiring the Studio for its artistic style and agree to trust the creative process.
8. Copyright & Usage
All images remain the copyrighted property of Megan Michael Photography.
Clients receive personal-use rights to purchased digital images. Images may not be altered, filtered, edited, or used for commercial purposes without written permission.
9. Model Release & Social Media Usage
Megan Michael Photography retains copyright to all images created.
The Studio may request permission to use images for:

  • Portfolio display

  • Website

  • Social media

  • Studio samples

  • Marketing materials

Client privacy is respected. Images will not be shared publicly on social media or used in marketing without the client’s explicit permission.
Clients may grant or decline usage consent at any time prior to publication.
10. Studio Safety & Liability
Clients assume responsibility for:

  • Personal belongings

  • Children under their supervision

  • Pets under their control

The Studio is not liable for accidents, injuries, or damage occurring on premises.
11. Product Quality & Manufacturing
The Studio partners with professional print labs and manufacturers.
Minor variations in color, texture, and finish are normal due to the nature of printing and materials and are not considered defects.
12. Chargebacks & Collections
By completing your purchase, you agree not to initiate a chargeback without first contacting the Studio.
In the event of collections proceedings, the client agrees to be responsible for associated legal and collection fees.
